- Road-Ready Certified Terms and Conditions Agreement
Throughout this Agreement, the words "we," "us," "our", and "ours" refer to Collector Car Network, Inc. an Arizona corporation doing business as Road-Ready Certified (RRC), its officers, employees, consultants, and subsidiaries. The words "you," "your," and "yours" refer to you, a user of the Service.
RRC hereby grants you a non-exclusive license to use this service for individual use of a personal nature. You may not: (1) modify, translate, or create derivative works based on the service, or permit other individuals to do so; (2) rent, lease, transfer or otherwise transfer rights to the service; (3) make copies of this report, or disseminate it any way without our express written permission.
Our vehicle inspections are prepared from visual and external checks only and are limited to the parts and/or items identified on the inspection report sheet. Vehicle inspections do not involve dismantling or disturbance of any structure, assembly, component or internal mechanism.
Items listed on the inspection report sheet that are not reasonably accessible on the checked vehicle will not be inspected. In such circumstances, we will be under no obligation to inspect and/or report on the part/item in question and will mark the relevant section of the report accordingly. RRC reserves the right to contract with third party vendors to perform inspections under RRC guidelines.
Without prejudice to the clauses above, please note that amongst the items we do not check are:
(a) Oil or fuel consumption
(b) Source of oil leaks
(c) Brake lining material
(d) Brake fluid for contamination
(e) Operation of cassette, compact disc players or other in car entertainment apart from a radio
(f) Quality of sound or radio reception, alarm systems and non-standard accessories
(g) Cylinder compression
(h) Vehicle electrics and electronics by the use of specific diagnostic equipment
(i) The accuracy of in-car computer systems
(j) Exhaust emissions, using gas-analyzing equipment
(k) Air conditioning function and efficiency by the use of specific diagnostic equipment
(l) Originality of specific components or equipment
Our inspection can only describe and/or identify defects actually found and/or which are reasonably capable of being found upon external visual consideration of the vehicle at the time of inspection. We cannot be held and are not responsible for any latent defects, which are later discovered.
Since our inspections are mobile, lifts may not be available unless the vehicle owner has one and agrees to place the vehicle on it. Our inspectors will not use a jack under any circumstances.
Road testing is carried out within the immediate area of the vehicle inspection. The term 'Test-Drive' does not necessarily mean that the inspector will actually drive the vehicle himself. If the seller refuses to grant permission, the vehicle is not legal for use on the road or deemed unsafe, the inspector may at his/her sole discretion elect to observe from the passenger seat or not ride in the vehicle at all. If, due to circumstances outside of our reasonable control, a road test cannot be carried out at the time of inspection, the original fee shall remain fully payable and an additional $150 fee will be payable for any subsequent road test we are asked to undertake.
The customer is required to confirm to us that the vehicle requiring an inspection is insured and has a current registration; we will not be obliged to carry out a test drive if the customer is unable to confirm that the vehicle concerned has a valid registration and is insured. The carrying out of a test drive does not mean that we have seen a valid registration certificate. RRC’s sole liability shall be limited to the refund of the fee. In no event will the liability of RRC and its employees, officers, directors, partners, agents and affiliates exceed the amount of the fees paid by you to RRC. Under no circumstances shall Road-Ready Certified, its parent or affiliated companies be responsible or liable for any injury or damage that may occur as a result of any mechanical failures or safety defects that are known or unknown at the time of the inspection.
Cancellation/refund/reschedule requests must be made 1 business day prior to the scheduled road test and inspection appointment. Cancellations/reschedule request MUST be received by email or telephone during normal business hours (8am-5pm Arizona M-F). Please provide name, order ID, and vehicle make/model information. You will receive an e-mail confirming the order has been cancelled or noted a reschedule is needed. If requesting cancellation/refund, refunds will be honored minus an administrative fee of $50. If your card has already been charged, you will receive a refund within 30 days of our written notice of cancellation.
In the event that the seller refuses permission for a test drive and inspection on the day of it is scheduled, or if the vehicle is inoperable and unable to be inspected through no fault of the inspector, no refund is granted. Also, if the vehicle seller refuses to allow a test drive or a test drive is unable to be performed for any reason (such as weather, etc.) but all other aspects of the test are completed, no refund is granted.

We shall not be liable for any delay in performing, or any failure to carry out an inspection to the extent that such delay or failure results from events or circumstances outside our reasonable control.
We shall not have, in any event, any liability or responsibility for any loss of profits, economic loss, loss of business and loss of goodwill (in all these cases whether direct or indirect) nor for any indirect, purely economic or consequential losses incurred as a result of or in connection with any inspection (including any non-occurrence thereof), whether resulting from breach of contract, negligence, breach of statutory duty or otherwise.
Vehicle inspections are supplied solely for the use of the customer and are not for the use of, or to be relied upon by, any third party and the customer shall be responsible for advising any such third party accordingly. The completed report is a copyright protected document and making copies is strictly prohibited. The information and services included in or available through the Service may include inaccuracies or typographical errors. Changes are periodically added to the information herein. RRC and/or its respective suppliers may make improvements and/or changes in the Service at any time. RRC does not represent or warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service or the server that makes it available, are free of viruses or other harmful components. RRC does not warrant or represent that the use or the results of the use of the Service or the materials made available, as part of the Service will be correct, accurate, timely, or otherwise reliable. You specifically agree that RRC shall not be responsible for unauthorized access to or alteration of your data. Further, RRC reserves the right to make changes to any and all parts of RRC products at any time, without obligation to notify any person or entity of such changes.
For the avoidance of doubt, under no circumstances will RRC be liable to any third party in contract, tort (including negligence) or otherwise for any loss (direct, indirect or consequential) which any third party may incur as a result of any information supplied by the inspection report.
You agree to indemnify and hold us and our vendors, service providers, subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to, or arising out of, your purchase of the RRC inspection or your use of the Service, any content you submit, transmit, or download through the Service, or any violation of this Agreement or the rights of others. If you are the owner or prospective purchaser of a vehicle that has been tested, inspected or certified by RRC you agree to indemnify and hold harmless RRC and its affiliates for any damages and injuries that occur as a result of a mechanical failure or safety defect of the certified vehicle.
You agree to defend, at your expense, any action brought against RRC or its parent company The Collector Car Network, Inc. arising out of your use of the service with any third parties or from your willful misconduct. You will indemnify us from any costs, damages and fees incurred by RRC, which are attributable to such a claim.
If any part of these terms and conditions are held by a court of competent jurisdiction to be unenforceable the validity of the remainder of the terms and conditions will not be affected.
Attorney Fees: In any litigation, arbitration, or other proceeding relating to the subject matter of this Agreement (whether in contract, tort, or both) or seeks a declaration of any rights or obligations relating to the subject matter of this Agreement, the prevailing party shall be awarded its reasonable attorney fees and costs and expenses incurred.
If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable, and such decision shall not affect the enforceability of such provision or of the remaining provisions of this Agreement. This Agreement shall be subject to and construed in accordance with the laws of the State of Arizona, without regard to conflicts of law provisions, and you hereby consent to the exclusive jurisdiction of the state and federal courts residing in the State of Arizona. Any and all unresolved disputes arising under this Agreement shall be submitted to arbitration in the State of Arizona. The arbitration shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. Notwithstanding the foregoing, we may obtain equitable relief in any court to protect our intellectual property.
Any controversy, dispute or claim arising out of, or relating to, the use of the Site or from product and/or services offered therein, shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and, if applicable, its Supplementary Procedures for Consumer-Related Disputes. Customer expressly waives any right to arbitrate a dispute as a class action and the right to a jury trial. The arbitrator's award is final and binding on all parties and judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction in Arizona.
RRC does not make any representation or expressed / implied warranties regarding its service, or in consideration of the vehicle’s design, compliance with any manufacturer specifications, operation, mechanical condition or safety of any vehicle inspected or any components/parts.
Title, ownership rights, and intellectual property rights in and to the Service shall remain with us. The Service and the intellectual property operating it are protected by the copyright laws of the United States and international copyright treaties. Title, ownership rights, and intellectual property rights in and to the content, and code accessed through the Service is our property and may be protected by applicable copyright or other law. All rights reserved. RRC products and services referenced herein are either trademarks or registered trademarks of RRC.
This license will terminate automatically and no refunds will be given if you fail to comply with the limitations described above. Upon termination, you must remove RRC copyrighted material from your computer.
RRC may at any time, and without notice, modify, update, or otherwise change the terms of this Agreement, and you agree to be bound by such changes. Accordingly, we encourage you to visit the Site from time to time to review the current Terms and Conditions.
This Agreement represents the complete agreement concerning this license between the parties and supersedes all prior agreements and representations between them. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable.
- Our Commitment to Your Privacy
- Information Collection and Use
Road-Ready Certified is the sole owner of the information collected on the Site. We collect personally identifiable information from our users at several different points on the Network.
In order to use certain features of the Site, such as ordering RRC services or subscribing to a newsletter, you must first provide us with your contact information (such as your name and email address). We use this information to contact you about the services on the Site in which you have expressed interest.
We may give you the option to provide basic demographic information (such as income, gender, and education) to us; we strongly encourage you to submit this information so we can provide our customers with a better, more useful experience on the Site. Providing any such demographic information is entirely optional and is identified as such at the time of data collection.
If you purchase a product or service from us, we request certain personally identifiable information from you on our order forms. You must provide contact information (such as name, email address, billing address, and shipping address) and financial information (such as a credit card number and expiration date).
We use this information for billing purposes and to process your orders. We also use this information to send you confirmations and updates of your orders. If we have trouble processing an order, we will use this information to contact you.
- Surveys or Contests
From time to time we may offer you the opportunity to participate in contests or surveys on the Site. If you participate, we may request certain personally identifiable information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and address) and demographic information (such as your age and ZIP code).
We use this information to gather feedback about Site features, notify contest winners and award prizes, and/or to send participants an email newsletter.
We may use a third-party service provider to conduct these surveys or contests; any such company will be prohibited from using our users’ personally identifiable information for any other purpose. We will not share the personally identifiable information you provide through a contest or survey with other third parties unless we give you prior notice.
- "Send to a Friend"
If you choose to use our referral service to tell a friend about the Site, we will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Site. We store this information for the sole purpose of sending this one-time email and for tracking the success of our referral program.
Your friend may contact us using our "Contact Us" form to request that we remove this information from our database.
- Communications from Us
We will occasionally send you information on new Site features, services, special deals, and promotions. Out of respect for your privacy, we present the option not to receive these types of communications. Please see "Choice and Opt-Out" below for more information.
If you wish to subscribe to our email newsletters, we will use your name and email address to send the newsletter to you. Out of respect for your privacy, we provide you a way to unsubscribe with each newsletter we send you.
We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email. Generally, you may not opt out of these communications because they are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.
Based upon the personally identifiable information you provide us, we will send you a welcoming email to verify your username and password. We will also communicate with you in response to your inquiries, to provide the services you request, and to manage your account. We will communicate with you by email and/or telephone, in accordance with your wishes.
- User Profile
We store information that we collect through cookies, server log files, tracking images, and third party sources to create a "profile" of your preferences. We tie your personally identifiable information, including your purchase history, to information in the profile, in order to provide you with tailored promotions and marketing offers and to improve the content of the Network for you.
- Supplementation of Information
In order to provide certain services to you, we may on occasion supplement the personal information you submitted to us with information from third-party sources. Examples of such sources include the following:
- Payment Verification
For your protection as well as ours, we use a third-party payment processing service to verify your billing address when we process your orders. We may also use a third-party verification service in order to safeguard against fraudulent credit card use.
- Enhancement of Profile Information
We may purchase marketing data from third parties and add it to our existing user database to better target our advertising and to provide pertinent offers in which we think you would be interested. To enrich user profiles of individual customers, we tie this information to the personally identifiable information they have provided to us.
- Information Sharing and Disclosure
We share aggregated demographic information about our visitors with our partners, affiliates, and advertisers. This information does not identify individual users; rather, it provides our partners, affiliates, and advertisers with a description of our user base as a whole. Partners may include third parties with whom we have or may have a business relationship, such as sponsors.
We share personally identifiable information with select third parties:
We use a shipping company to fulfill orders for goods, and we use online payment processing companies to bill you for goods and services. These companies do not retain, share, store, or use personally identifiable information for any other purposes.
We use third parties to fulfill orders for certain goods and services. These companies may retain, share, store, or use personally identifiable information subject to their own privacy policies.
We use a third party to provide email newsletter mailings. When you sign up for a newsletter, we will share your email address and certain elements of your Profile as necessary for the third party to provide that service.
- Legal Disclaimer
We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on us.
- Choice and Opt-Out
We provide you with the opportunity to "opt out" of having your personally identifiable information used for certain purposes when we ask for this information. For example, if you register for an account with us but do not wish to receive any additional marketing material from us, you can click the unsubscribe link at the bottom of any email.
If you no longer wish to receive our newsletter and promotional communications, you may opt out of receiving them by following the instructions included in each newsletter or communication.
You will be notified when your personal information is collected by any third party that is not our agent or service provider, so you can make an informed choice as to whether or not to share your information with that party.
- Log Files
As is typical of professionally managed websites, we gather certain information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data for each user of the Site.
We use this information, which does not identify individual users, to analyze trends, to administer the Site, to track users’ movements around the Site, and to gather demographic information about our user base as a whole.
Generally, we do not link this automatically-collected data to personally identifiable information. IP addresses are, however, tied to personally identifiable information in conjunction with orders in order to help prevent online payment fraud.
A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We do not store any personally identifiable information in cookies, but we may link the information we store in cookies to personally identifiable information when required for technical reasons, such as in keeping track of your account information or shopping cart.
We use both session cookies and persistent cookies. We use session cookies to make it easier for you to navigate the Site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s documentation. We set a persistent cookie to help keep track of visits our users make to the Site. Persistent cookies also enable us to track and target the interests of our users to enhance their experience on the Site. If you reject cookies, you may still use the Site, but your ability to use many areas of the site will be limited.
- Tracking Graphics
We and/or our third-party partners employ a software technology called tracking graphics (a.k.a. "Web beacons" or "Web bugs") that help us better manage content on the Site by informing us what content is effective. Tracking graphics are tiny, transparent images with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, tracking graphics are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. As with cookies, we may tie the information gathered by tracking graphics to our customers’ personally identifiable information.
We use tracking graphics in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. If your personally identifiable information changes, or if you no longer desire our services, you may correct, update, or deactivate it by making the change on our member account pages.
The security of your personal information is important to us. When you enter sensitive information (such as a credit card number) on the Site, we encrypt that information using secure sockets layer technology (SSL). We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. In the event Collector Car Network, Inc goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personally identifiable information will likely be among the assets transferred.
